1. Acceptance of Terms
By accessing this website or purchasing from Primary BioLabs, you agree to be bound by these Terms & Conditions, our Research Use Policy, and our Privacy Policy. If you do not agree to all of these terms, do not use this site or purchase any product.
2. Research Use Only — No Medical, Therapeutic, or Consumption Claims
All products sold by Primary BioLabs are research chemicals intended exclusively for in-vitro laboratory and preclinical research use by qualified professionals. They are not drugs, dietary supplements, cosmetics, or consumer products, and are not for human or veterinary consumption, injection, or any therapeutic use. Primary BioLabs does not market, promote, or endorse its products for medical, diagnostic, or therapeutic purposes, and does not provide instructions for any use beyond legitimate laboratory research. These statements have not been evaluated by the FDA, and no product is intended to diagnose, treat, cure, or prevent any disease.
3. Eligibility & Purchaser Representations
You must be at least 21 years of age and a qualified researcher, laboratory professional, or authorized representative of a research institution to purchase from Primary BioLabs. By placing an order, you represent and warrant that you meet these requirements, that you are purchasing solely for legitimate in-vitro or preclinical research, and that you will not use, resell, or transfer any product for human or veterinary consumption or any unauthorized purpose.
4. Informed Consent & Assumption of Risk
Research chemicals may be hazardous if mishandled. By purchasing, you acknowledge that you understand and accept full responsibility for the safe handling, storage, and disposal of any product you receive in accordance with applicable laboratory safety standards; for compliance with all local, state, and federal laws governing the possession and use of research chemicals in your jurisdiction; and for any health or safety risk arising from exposure to, or improper handling of, these products. You assume all risk associated with the purchase, receipt, storage, and handling of Primary BioLabs products.
5. Waiver of Claims & Indemnification
You waive any claim against Primary BioLabs, its owners, employees, and affiliates arising from toxicity, contamination, or accidental exposure; improper use or storage leading to harm; or any unauthorized use or transfer of a purchased product by you or any third party. You agree to indemnify and hold Primary BioLabs harmless from any liability, damages, claims, or legal action arising out of your misuse of any product or your violation of these Terms.
6. Orders, Pricing & Right to Refuse Service
All orders are subject to acceptance and product availability. Prices are listed in USD and may change without notice. Primary BioLabs reserves the right, at its sole discretion, to refuse, limit, or cancel any order, to request additional information to verify a purchaser’s eligibility, and to decline sales to any individual, organization, or jurisdiction where such a sale would be restricted or prohibited by law.
7. Shipping & Returns
Products are shipped in temperature-controlled packaging as described in our Shipping Policy. Refunds and replacements are handled under our Refund & Return Policy. Because these are laboratory chemicals, all sales are otherwise final once a product has been delivered in the condition described.
8. No Warranties
All products are sold “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Primary BioLabs does not warrant the accuracy, completeness, or reliability of any product data beyond what is stated on the product’s Certificate of Analysis.
9. Limitation of Liability
To the fullest extent permitted by law, Primary BioLabs is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the purchase, handling, storage, use, or misuse of any product, even if advised of the possibility of such damages. The purchaser assumes full legal and financial responsibility for their own compliance with applicable law.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United States and the state in which Primary BioLabs is operated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your purchase shall first be attempted to be resolved informally by contacting us; unresolved disputes may be subject to binding arbitration on an individual basis, and you agree to waive any right to a jury trial or to participate in a class action, to the extent permitted by law.
11. Changes to These Terms
Primary BioLabs may update these Terms from time to time. Continued use of the site or future purchases after changes are posted constitutes acceptance of the revised Terms.
